These terms and conditions establish the rules governing the awarding of the prize of the "Be a local like Ricky Rubio" draw.
The Catalan Tourist Board (hereinafter, “the organiser”), with Spanish Tax ID no. S0800470G and registered address at Passeig de Gràcia, 106, 3a planta, Barcelona, is the organiser of this random promotional draw for the international tourist destination of Catalonia (hereinafter, “the promotion” or “the draw”).
The Catalan Tourist Board reserves the right to cancel, suspend or modify these terms and conditions, as well as the organisation and/or management of this promotion, provided that there are reasons that justify it. Justifiable cause shall always be understood as restrictions that may be imposed by countries with regard to Covid-19.
2. TERRITORIAL SCOPE
This draw has a global territorial scope, as it is being held online. This means that people of any nationality or residence can participate.
3. PARTICIPATION CRITERIA
All natural persons over 18 years of age, of any nationality or residence, who have not been involved in any way in designing or structuring this prize draw, may participate in it. This rule affects, among others, employees of the Catalan Tourist Board and, where applicable, of collaborating companies, as well as their spouses, parents, children and other relatives by blood or affinity up to the first degree of all of the above. Failure to comply with this rule will result in automatic forfeiture of the prize.
Participation is free and constitutes full and unconditional acceptance of these terms and conditions, which will in any case be made available for consultation by the participants. Eligibility for the award is dependent on the fulfilment of all the requirements set out in this document.
4. VALIDITY OF THE PROMOTION
The promotion will be valid from 14/09 (UCT+1) on 09:00 until 27/09 (UCT+1) on 23:59, both days included.
The Catalan Tourist Board reserves the right to extend the end date of the promotion by announcing it on the participation website.
5. DESCRIPTION OF THE PRIZE
A flight from the winner’s home country (from the airport closest to his/her municipality of residence) to Barcelona Airport.
It also includes the costs pertaining to transport, accommodation and meals (breakfast, lunch and dinner) for all days of their stay in Catalonia.

- Dinner at the hotel.
Day 2 – Visit to Barcelona.
- Breakfast at the hotel

Day 3 – Visit to Barcelona.

Not included in the prize:
Expenses other than those mentioned above, such as travel to the airport in the country of origin or meals other than those stipulated in the prize details, as well as other additional expenses not stipulated in the prize, are not included.
The value of the prize will depend on the winner’s country of residence and will be a maximum of the value shown in the table below:

Dates on which the prize can be redeemed:
The prize can be redeemed until 31 December 2022.
The Catalan Tourist Board and, where applicable, the companies collaborating in this promotion, will under no circumstances be responsible for damages of any nature, be they direct, indirect and/or circumstantial, whether immediate or deferred, which may arise as a consequence of the corresponding prize and/or draw. Participation in this draw implies express acceptance of this condition.
The prize that is the object of this draw is subject to the obligations required by the current tax regulations, which include the practice of the appropriate payments on account in each case. For these purposes, before redeeming the prize, the Catalan Tourist Board will ask the beneficiaries to accredit their tax residence and will issue a certificate stating the final value of the prize.
The prize that is the object of this draw will be subject to legally established tax obligations and deductions.
Under no circumstances may the prize be exchanged for its cash value.
6. PARTICIPATION IN THE DRAW
Participants will receive an email confirming acceptance of their participation.
Each participant will be assigned a unique ID code to be used in the draw.
People cannot enter the draw more than once.
No entry will be accumulated for registration on more than one occasion.
Any fraud or attempted fraud, in particular, the provision of incorrect information or falsification of address or identity, non-compliance with these rules or any attempt to disrupt the running of the draw will result in the automatic elimination of the participant(s) involved and possible legal action by the organising company.
Any winner who disrupts the running of the draw in any of the ways described above will lose the right to redeem his/her prize. All participants, and in particular the winner, expressly accept and consent to any actions which seek to verify their identity. The illegibility, inconsistency or falsification of the participant’s identity or address will result in the automatic elimination of his/her participation and the cancellation of the prize won.
7. DRAW MECHANICS AND PRIZE NOTIFICATION
The draw will take place within a maximum period of 7 working days from the final day of participation in the promotion, involving all the participants who have filled in their details in accordance with the provisions outlined in these terms and conditions.

The draw will result in one winner and two runners-up.
The result of the draw will be notified to the winner within a maximum period of 5 working days via the e-mail address provided in the form. The winner must accept the prize within 3 working days of receipt of the prize notification e-mail. This acceptance must be communicated to the organiser via the acceptance document provided, which must be signed and then e-mailed to info.discover@catalunya.com
If for whatever reason beyond the control of the Catalan Tourist Board, the winner cannot be contacted or does not accept the prize, it will be understood that he/she has renounced the prize. It will then be offered to the first runner-up, who will also have to accept the prize within a maximum period of 3 working days. This process will continue until there are no more runners-up.
If neither the winner nor the runners-up accept the prize, a new draw will be conducted with the other participants through the same Easypromo platform and in accordance with the mechanics established in this section.
If this second draw also fails to produce a winner, the prize will not be awarded.
The Catalan Tourist Board shall be exempt from any liability that may arise from errors in the data provided by the successful participants if it is not possible to identify them.
Awarding of the prize:
The prize will be awarded by the Catalan Tourist Board within a maximum period of one month from the day on which the winner accepted the prize. Travel and reservation documents will be sent to the winner by e-mail, together with the travel itinerary.
The prize can only be awarded to the person named in the entry. The use and redemption of the prize are reserved for the person named in the winning entry and the person he/she expressly designates as his/her companion. Under no circumstances may the prize be transferred or exchanged with another person, nor may it be the subject of compensation.
The winner will be exclusively entitled to redeem the prize obtained as such, without being able, in any case, to request any economic compensation for not accepting the prize.
8. ACCEPTANCE OF THE TERMS AND CONDITIONS AND COMPLAINTS
Participation in the draw implies full acceptance of all the clauses contained in these terms and conditions, as well as express submission to the interpretative decisions made by the Catalan Tourist Board as the organiser of the draw.
Complaints related to this draw can be e-mailed to the Catalan Tourist Board at info.discover@catalunya.com within a maximum period of 30 days from the end of the promotion.
9. DATA PROTECTION
The Catalan Tourist Board will serve as the Data Controller, as defined in article 26 of the General Data Protection Regulation.
The organiser will serve as the Data Processor, managing people’s participation in the draw; managing the prize itself; and keeping applicants informed of everything relating to their participation in the draw. Likewise, if the person concerned expressly consents, his/her data will also be used to send commercial offers and newsletters related to tourism in Catalonia which the Catalan Tourist Board feels may be of interest to them.
The services of the company Easypromos are used to select the winner and runners-up in the draw. Easypromo acts as Data Processor, and the corresponding agreement regulating its status as such is in place, granting it access to these data for said purpose on behalf of the Catalan Tourist Board. These data cannot be used for any other purpose.
The organiser may retain the data of the prize-winners as far as this is necessary for the fulfilment of its legal obligations or its functions, or to preserve its legitimate interests and in accordance with the applicable data retention regulations.
Participants may exercise their rights of access to data, rectification, erasure, portability, limitation of processing and/or objection by sending an email to the Data Protection Officer at lopd.act@gencat.cat. If a satisfactory response about the exercising of rights is not obtained, a complaint may be lodged with the relevant supervisory authority. In this case, it is the Catalan Data Protection Authority (www.apd.cat).
10. IMAGE RIGHTS
The Catalan Tourist Board and, where appropriate, the collaborating companies, with the express consent of the winner, may reproduce and use his/her whole name and other details, as well as his/her image, in any advertising and/or promotional activity related to the draw in which he/she has participated, without such use conferring any right to any remuneration or benefit whatsoever except for the prize subject to the draw.
11. RESPONSIBILITY
The Catalan Tourist Board accepts no responsibility in the event of illness, accident or any other circumstance requiring travel insurance.
Consequently, the winner undertakes to take out medical and travel insurance before leaving their country or city of origin to cover their stay in Catalonia.
The Catalan Tourist Board shall not assume any liability for any claim, loss, damage, cost or expense arising from injury, accident or death, damage, loss or delay of baggage or other property, inconvenience, loss of remuneration, danger or frustration, whether physical or mental, resulting from, but not limited to:
1 - Mechanical breakdowns, governmental actions, strikes, lockouts due to war, weather, acts of force majeure, acts of terrorism or other factors beyond our control;
2 - Acts of vandalism, air, land or sea piracy, theft, accidents, fire, injury, assault or any other physical damage to your property and/or person;
3 - Your failure to follow instructions, including those relating to passports and visas.
12. APPLICABLE LAW AND COMPETENT JURISDICTION
These terms and conditions are governed by Spanish law.
Any question of litigation that may arise in relation to the validity, interpretation and/or application of these terms and conditions are expressly submitted to the jurisdiction of the courts corresponding to the place of fulfilment of the obligation, which is the place where the prize is redeemed.
